Afghan massacre: Lawyer eyes PTSD defense

John Henry Browne, the attorney who defended Ted Bundy and the so-called Barefoot Bandit, talks to TODAY's Matt Lauer about his possible defense strategy, saying a post-traumatic stress disorder (PTSD) defense is likely, and says there's a significant amount of misinformation about his client circulating.

Updated at 9:54 a.m. ET: The case against the U.S. soldier accused of killing 16 Afghan villagers is "more political than legal" and the defense will likely focus on post-traumatic stress disorder (PTSD), his lawyer told NBC News on Friday.

Attorney John Henry Browne, who is representing the soldier, said the suspect?had been training to become a military recruiter after three tours of duty in Iraq but had been ordered to return to Afghanistan "overnight."

?"There will be efforts to paint him as a rogue soldier rather than focusing on how we treat GIs in general or whether we should be over there to begin with," he told TODAY?s Matt Lauer in an exclusive interview.

The soldier was "en route" to the military prison in Levenworth, Kansas, U.S. officials told NBC News on Friday morning.

Meanwhile, Afghan President Hamid Karzai on Friday accused the United States of failing to fully cooperate with an investigation into the massacre and questioned whether only one soldier could have been involved.

A series of blunders by the United States, including the killings in Kandahar province on Sunday and the inadvertent burning of copies of the Koran at a NATO base last month, has further strained already tense relations between the countries.

New details have emerged about the U.S. soldier accused of killing 16 civilians, including nine children, during a shooting spree in Afghanistan. NBC's Richard Engel reports.

Browne told Lauer reports that the staff sergeant had been suffering marital problems were "absolutely not true" and "offensive," adding the soldier has "a very strong and loving relationship with his wife."

He added that he would not be naming his client until the U.S. government formally released the man's identity. ?"I?ve been told by the government... that there is a great deal of security concern and I will go along with that until the government reveals his identity... not only concern for him but his family," Browne said.

?Browne also told The Associated Press that?his client saw his friend's leg blown off the day before the rampage. Browne said that according to his client's family, he was standing next to another U.S. soldier when that soldier was gravely injured.

Browne?said?the?suspect had suffered a "concussive head injury" concussion and lost part of his foot during deployments to Iraq.

The lawyer, who has previously defended serial killer?Ted Bundy, told?TODAY that the soldier had been screened for PTSD after the head injury and been cleared, but characterized the testing as "minimal".

Browne?also?said that the suspect had not confessed, adding: "He wasn?t exactly sure of the facts, which raises some question in my mind about his state of mind."

'He just snapped'
Earlier,?the New York Times?reported that a senior American official as saying the suspect had been drinking alcohol the night of the massacre?and was suffering from the stress of a fourth combat tour and tension with his wife.

?When it all comes out, it will be a combination of stress, alcohol and domestic issues ? he just snapped,? the official said, according to the Times. The newspaper said the official had been briefed on the investigation and spoke on condition of anonymity because the soldier has not been formally charged.

Browne told NBC News alcohol was "maybe" involved but said it was not clear if this was the case.

The military was move him to a prison in the United States as early as Friday, most likely to Fort Leavenworth, Kan.

The suspect had been flown to a detention site in Kuwait on Thursday.?However,?the Times said the official said that there was a diplomatic uproar when Kuwait learned from news reports that the soldier had arrived at an American base there. The official said that "the Kuwaitis blew a gasket and wanted him out of there.?

The Times said the official's account had been confirmed by a senior official at the Pentagon.

At a news conference on Thursday night, Browne said it would be at least a few weeks until charges are filed.

The soldier in custody?is 38, married and has two children, ages 3 and 4. Sources have told NBC News that he enlisted soon after 9/11, trained as a sniper and was based at Joint Base Lewis McChord, about an hour south of Seattle. He served three tours in Iraq.

He arrived in Afghanistan in December and was assigned to a village stability operation. He is accused of slipping off the base early Sunday, walking to a village, entering homes and opening fire. Among the dead were nine children and three women. Of the 16, 11 came from one family. Five others were injured.

Karzai: Get U.S. troops out of our villages

Secretary of Defense Leon Panetta has said the death penalty may be applied in this case. ?

Browne, who recently represented Colton Harris-Moore, the so-called Barefoot Bandit, said he has spoken with the soldier?s family ? who Army officials said had been moved onto the base for their safety.

Browne said he has only handled three or four military cases before, the AP reported. The soldier will also have at least one military lawyer.

On Friday, Karzai told reporters at his palace in Kabul: "The army chief has just reported that the Afghan investigation team did not receive the cooperation that they expected from the United States. Therefore these are all questions that we'll be raising, and raising very loudly, and raising very clearly."

Flanked by senior officials, Karzai met with village elders and the families of victims of the massacre, and dressed somberly in black for the start of two days of talks to discuss the killings.

"They believe it's not possible for one person to do that. In his family in four rooms people were killed, women and children were killed, and they were all brought together in one room and then put on fire. That, one man cannot do," Karzai said.

With several investigations still underway by both U.S. and Afghan officials, any discovery of more than one soldier involved in the incident would be a disaster for NATO, with Western leaders needing to win over Afghans ahead of a withdrawal by most foreign combat troops in 2014.

On Thursday, Karzai called for NATO troops to leave Afghan villages and confine themselves to major bases, underscoring fury over the massacre and clouding U.S. exit plans.

He also demanded the handover of security to Afghan police and soldiers by 2013, a year ahead of schedule.

Such a move could undercut U.S. President Barack Obama's strategy for Afghanistan and hamper efforts to mentor Afghan police and help with local governance.

Since I?m now in the market for a new gaming computer, I?ve been pricing models from all over?but more importantly, I?ve been looking for the functionality I need. I want a computer that can play City of Heroes without any graphic hiccups or performance slowdown; I also want one that handles longer sessions of gaming without harm. I know that if it can handle gaming, it can handle everything else I want to do with ease.

Knowing the number of people daily who are in the market for such a computer as I am, I thought I?d share some of my search tips and discoveries.

Beginning Your Search: Learning System Requirements

First, find the website(s) for the particular game(s) you?d like to play on your new computer. You?re looking for a page called ?System Requirements? or something similar, something that tells you what kind of graphics card, hard drive, and processor are recommended to play your game. (You can also do a search for ?[your game] system requirements? if the game website doesn?t have that info readily available.

Make a note of each game?s mininum, recommended, and maximum requirements, and then compare requirements across all the games you want to play. (Some games may require you to have a stronger processor than others, and some may need a better graphics/video card than others.)

Figuring Out Which Components are Strictly ?Better? Than Others

If you?re like me and not exactly up on which model numbers mean better quality, you?re going to have to do some internet research to find out which version of each component is the best.

For instance, City of Heroes lists a couple of graphics cards on its system requirements list. Since I don?t know how those compare to any of the computers on the market, all I can do is compare the model numbers to that listed for any computer I?m looking at. Then, I have to find out from the various companies? product lists whether the computer?s onboard graphics card is the same as or better than the one listed in the system requirements, or vice versa.

What to Look For/What to Skimp On

When you?re looking for a gaming computer, I have found that you should search for excellent quality in the following areas:

• RAM: The more gigabytes of RAM you have, the faster your gaming will perform. Having a good quantity of RAM is more important to gaming than hard drive speed.
• Hard drive speed: The faster your hard drive is, the faster your game will load initially, but this is not quite as important. (It is important, however, if you plan to do other things with your computer besides game.)
• Dedicated graphics card RAM: For gaming performance, it?s recommended that the graphics card have its own store of RAM to work with, as well as the computer?s general RAM. Having had a computer with dedicated graphics RAM, I can tell you that it makes a wonderful difference in how the game looks and performs. Integrated graphics cards?just don?t. My second laptop?s motherboard was MELTED by an integrated graphics card?I gamed with it too much and too long.
• Cooling vents: A gaming computer?s internal parts will generate lots of heat while providing you with the most awesome experience it can muster. It needs a lot of vents to get rid of that heat, otherwise it will overheat and even melt some of the components!
• Processor: Having a processor that can run multiple things at once is a must for gaming. You don?t want to go for lots of RAM and cheap out on the processor?the processor is the computer?s true brain, its hardest worker.
• Visual display: You don?t want to have a dingy or colorless display after you?ve spent all this money getting great components elsewhere. Make sure your monitor is up to the task of displaying all this gaming awesomeness.

However, there are some computer features that don?t have to be super-upgraded for gaming performance. You can quite feasibly skimp on the following:

• Laptop battery life: If you?re gaming with your laptop, you likely won?t let it run without plugging it into the wall, so you don?t need to worry quite so much about battery life.
• CD/DVD/Blu-ray drive: Unless you plan to install a lot of older CD-driven games, you probably won?t need a high-powered optical drive.
• Number of USB ports: Especially for online gamers, the number of USB ports is not as important. Take this into consideration only if you use a lot of flash drives or external hard drives at one time.
• Appearance of computer: The glossy finish or bright color won?t matter as much as performance will!

But Wait, You Haven?t Told Us Brand Names to Buy!

Nope, because each brand has seemingly an equal amount of fans and haters. Antidepressant shows promise as cancer treatment

ScienceDaily (Mar. 12, 2012) ? An antidepressant combined with a drug derived from vitamin A could be used to treat a common adult form of leukemia, according to laboratory research led by a team at The Institute of Cancer Research (ICR).

A retinoid called all-trans retinoic acid (ATRA), which is a vitamin A-derivative, is already used successfully to treat a rare sub-type of acute myeloid leukemia (AML) *, however this drug has not been effective for the more common types of AMLs.

Team leader Dr Arthur Zelent and colleagues at the ICR, with principal funding from leukemia & Lymphoma Research, have been working to unlock the potential of retinoids to treat other patients with AML. In a paper recenlty published in Nature Medicine, they show that the key could be an antidepressant called tranylcypromine (TCP).

"Retinoids have already transformed one rare type of fatal leukemia into a curable disease. We've now found a way to harness these powerful drugs to treat far more common types of leukemia," senior author Dr Zelent, from the ICR, said. "Until now, it's been a mystery why the other forms of AML don't respond to this drug. Our study revealed that there was a molecular block that could be reversed with a second drug that is already commonly used as an antidepressant. We think this is a very promising strategy, and if these findings can be replicated in patients the potential benefits are enormous."

ATRA works by encouraging the leukemia cells to mature and die naturally. The team thinks the failure of AML to respond to this drug may be due to genes that ATRA normally targets becoming switched off. In their search for a drug that could be used to reboot the activity of ATRA, the team looked to an emerging area of research called epigenetics. Epigenetic drugs do not target genes directly but instead target whether genes are switched on or off. They discovered that inhibiting an enzyme called LSD1, using TCP, could switch these genes on again and make the cancer cells susceptible to ATRA.

Along with collaborators at the University of M?nster in Germany, the team have already started a Phase II clinical trial of the drug combination in acute myeloid leukemia patients.

Co-author Dr Kevin Petrie from the ICR says: "Both the retinoid ATRA and the antidepressant TCP are already available in the UK and off-patent, so these drugs should not be expensive for the health service. AML remains very difficult to treat and sadly is often fatal, with rates of the disease projected to increase significantly as the population ages, so it is particularly pleasing to have identified this new treatment approach. Importantly, we believe these drugs are targeting only the cancer cells and leaving normal healthy cells largely untouched, so we are hopeful that they would have fewer side-effects for patients than standard drugs. We look forward to seeing the results of the clinical trials."

Each year, more than 2,200 people in the UK are diagnosed with acute myeloid leukemia, a type of cancer characterised by the uncontrolled growth of immature white blood cells in the bone marrow.

Professor Chris Bunce, Research Director at leukemia & Lymphoma Research, said: "These results are extremely significant. Current drugs for AML are very aggressive and many older patients have a poor outlook as they cannot tolerate treatment. ATRA has been a major success story in recent years in treating a particular subtype of AML. In finding a way to expand its use, we would have the potential to save thousands of lives a year."

The study was a collaboration between scientists at the ICR, Cardiff University and Queen's University, Belfast, in the UK; Johns Hopkins University, Baltimore, Progen Pharmaceuticals and Medical University of South Carolina in the US; the University Health Network and the University of Toronto in Canada; and the University of M?nster in Germany. It was funded in the UK by leukemia & Lymphoma Research along with the Samuel Waxman Cancer Research Foundation.

Column: Messi-ah or just Messi? Doesn't matter

PARIS (AP) -Two months ago, Pele was asked the same question many people are asking again now: Is Lionel Messi better than you were?

"Difficult to say," the great man replied. "When Messi has scored 1,283 goals like me, when he has won three World Cups, we can talk about it again."

There are two ways to understand that answer.

One, of course, is 'No.' His latest record-setting five-goal feat in the Champions League notwithstanding, Messi still cannot definitively be called the greatest footballer of all time. Perhaps no one can.

But the other and more diplomatic point Pele possibly was trying to make is that, unlike the Brazilian, Messi is still an art work in progress. He has not finished sculpting his place in football history. Not even close. Messi, greatest ever? Why are we discussing this now? Come back and see me in 10 years.

Also, pitting one generation against another is often treacherous, even pointless.

Rod Laver played with a small wooden racket; Roger Federer has a big graphite one. So how can those tennis legends be compared, given that the sport Federer plays bears only a passing resemblance to the one Laver knew?

Likewise, football is faster, more commercial, more all-consuming and more of a science than it was in the day of Pele and Maradona.

Still, that won't stop Messi fans from placing him at the top of the 'best-ever' pile every time he does something remarkable - which, admittedly, does seem to be almost every time he runs onto the field.

"He is the best player in football's history and we've never seen anyone like him" was his teammate Cesc Fabregas' verdict after Messi put five - yes, five - goals past Bayer Leverkusen on Wednesday night.

The last player to score five in European football's top club competition was Soren Lerby of Ajax against Omonia in 1979. Messi is the first to do it since the European Cup was re-branded the Champions League in 1992.

"One day he'll score six," said Barcelona coach Pep Guardiola.

That's not hard to believe.

But, objectively, all that Messi has achieved at this point in his career is the right to be mentioned in the same breath as Pele and Maradona - or Maradona and Pele, the order depending on which of those two you consider to be the best.

The World Cup remains a big black hole on Messi's CV.

"When he plays with Argentina, he doesn't have the same success," Pele noted. "People are always asking me, 'When will there be a new Pele?' Never! My father and mother shut down the production line."

But with each new record, each additional trophy he wins with Barcelona, the stronger the argument for Messi becomes.

All being well, Messi will this month or next become the first player to score more than 12 Champions League goals in a single season. He will also soon net the eight goals he needs to become the all-time record scorer in Barcelona's illustrious 113-year history. Cesar Rodriguez, at least for a few more weeks, now holds that club record with his 235 goals in official matches from 1942-55.

And Messi is still only 24. If he carries on at this rate for another five or even 10 years, the Messi, Maradona or Pele debate maybe will have a clear winner.

"When he finishes his career he may be the considered the best ever," said Barcelona midfielder Xavi Hernandez.

Given the competition from Pele and Maradona, however, that is still a big 'if.'

The simplest and fairest solution is this: Accept that, for each era, there is a footballer who towers above the rest. Pele, Maradona, Zinedine Zidane and now, unquestionably, Messi.

But we don't need to compare Messi against those other players to understand a blindingly simple truth: The way he plays football, his humble and inventive genius, is an absolute delight to behold.

How lucky we are to live in his time.

But fans in Pele and Maradona's eras felt that way, too.

The Super Tuesday primaries were held yesterday, and "Colbert Report" host Stephen Colbert could barely contain his excitement.

He likened the big political day to the Super Bowl, saying he?s even painting his face the team color -- white (and in his case, that means no paint required). And just as he would with football?s big day, Colbert decided to throw a little tailgate party. He cooked some bratwursts on a fake grill and explained his famous "ten-layer dip," a concoction of ingredients he said represents each state having a primary -- including Idaho potatoes, Virginia ham, Vermont cheese, Alaskan venison and a layer of rust from Ohio.

To get the party started, Colbert added a batch of his famous ?Republican salsa,? which was really just a bowl of mayonnaise with a dash of Miracle Whip on top. As for drinks, he whipped up a batch of margaritas. Unfortunately, he couldn't find his blender so he did the mixing with a trans-vaginal ultrasound wand.

"Usually at my parties (the wand) doesn't come out until after the margaritas," he quipped. So with the party plans in place, it was on to the results. Colbert took off his jacket, rolled up his sleeves and noted that the candidates were all seeking one particular voter: the working-class man or woman. He pulled out an actual blue collar from his lunch pail and put it on.

"Just an average working Joe. Hey, fellas, let's head over to the factory plant and foundry us some metal goods. Welding, am I right? You know, some of my best friends own this company," he said parodying a Romney-esque statement.

On to the results, of which there were none -- "Report" taped too early to be able to actually report anything definitive. But Colbert wasn't going to let all of his effort go to waste -- he was going to report on the results of something. So he declared that Vladimir Putin is once again the president of Russia and that the Samajwadi Party has triumphed in the India State Assembly elections.

"The Daily Show" was in the same boat as "Report" in terms of reporting results -- a taping that happens too early to make jokes about the numbers -- but that didn't stop Jon Stewart. Instead, he focused on the one state all of the candidates had something to say about today -- the state of Israel.

"That's right, each candidate took time out today from the biggest primary yet to address the American-Israel Political Action Committee," reported Stewart.

Prices at the pump ease after 27-day streak

For the first time in nearly a month, you may notice prices at the pump a little bit easier on the wallet.

The nationwide average for gasoline prices eased Tuesday, marking the first decline after 27 straight days of increases, according to the motorist group AAA.

The average price of regular unleaded gasoline fell three-tenths of a cent to just above $3.76 a gallon, AAA said.

The nationwide average was $3.48 a gallon a month ago and $3.72 a week ago. Last year at this time, the average price stood at $3.51 a gallon.

The average price is 35 cents, or about 8.5 percent lower than the record high of $4.11 on July 17, 2008.

Average prices for regular gasoline top $4 a gallon in California, Alaska and Hawaii. At $4.38 a gallon, Hawaii ranks as the nation's high. Prices are within a few cents of the $4 mark in Connecticut, Oregon and New York, according to AAA.

Wyoming has the nation's lowest gas prices, averaging $3.23 a gallon.

Oil prices hovered below $107 a barrel Tuesday in Asia after U.S. and Israel leaders met to discuss growing tensions over Iran's nuclear program.

After a meeting Monday in Washington, President Barack Obama and Israeli Prime Minister Benjamin Netanyahu showed no sign of give on competing ways to resolve the crisis. Obama urged pressure and diplomacy to prevent Iran from getting a nuclear bomb while Netanyahu emphasized his nation's right to a pre-emptive attack.

The U.S., Europe, Israel and other nations fear that Iran may be building a nuclear weapon. Iran, the world's third-largest oil exporter, denies the charge.

"The Iranian fear premium didn't change in our view," energy consultant Ritterbusch and Associates said in a report.

Crude has risen from $96 last month amid investor concern that a military conflict aimed at destroying Iran's nuclear capabilities would disrupt global oil supplies. Analysts say Saudi Arabia and other oil producers do not have enough spare capacity to quickly make up for Iran's 4 million barrels a day of crude.

Analysts estimate crude would jump to $150 in the wake of an attack by Israel on Iran's nuclear operations.

"The risk of a supply disruption due to geopolitical factors is uncomfortably high and increasing," said Richard Soultanian of NUS Consulting.

Gas prices have been rising on the back of soaring oil prices, which have surged 10 percent over the past month amid fears that tensions with Iran will lead to an all-out war that causes a disruption in oil supplies.?

Signs of an improving economy have also boosted oil prices, as has the stock market. All three major indexes hit multi-year highs in the past week, but have finished in the red for the past two trading days.

As the Republican primaries hit full throttle on Super Tuesday, the candidates have used gas prices to attack their opponents as well as Obama.

On Sunday's morning talk shows, Newt Gingrich said that that rising gas costs would provide a surge to his candidacy, as he has pledged to get prices down to $2.50 a gallon.

"The price of gasoline is becoming a genuine crisis for many American families," he told CNN's Candy Crowley, saying it would be a "pretty big burden" for Obama come November.

Meanwhile, speaking in Georgia, Mitt Romney refused to promise a lower gas price like his rival.

"I'm not gonna come here and pander to you and say here's what your gasoline price will be if I do all those things," Romney told the Atlanta audience.

Last week, Gingrich accused Obama of slowing domestic production and contributing to high prices. Romney, meanwhile, advocates opening federal lands to drilling and easing regulations on fracking -- a controversial policy that involves pumping water into rocks to harvest gas.

In a speech last week in New Hampshire, Obama stressed that domestic oil and gas production is at its highest point since 2003, and that the United States has more working oil and gas rigs than the rest of the world combined. But he also emphasized the need to develop new energy sources, as domestic production alone is not enough to keep up with U.S. demand.
